Welcome to Whisky Labs. By engaging with our services, you agree to the following Terms & Conditions. Please read them carefully before entering into any agreement with us.
These Terms & Conditions (“Terms”) govern all services provided by Whisky Labs (“Company”, “We”, “Us”) to the Client (“You”). By signing a proposal, contract, invoice, or making payment, you accept these Terms.
Whisky Labs provides services including, but not limited to:
Digital Marketing
Social Media Marketing
Performance Marketing
Shopify Website Development
SEO Services
Branding & Creative Content
UGC Content Creation
Influencer Marketing
Website & Technical Support
The scope of work will be defined in the proposal or service agreement.
Payments must be made in advance unless stated otherwise.
For retainers, invoices are billed monthly.
For one-time projects, payments follow a milestone or full upfront structure.
Work will commence only after the agreed initial payment is received.
Late payments may delay delivery timelines or pause services.
All payments made to Whisky Labs are non-refundable.
In case of cancellation, any work completed up to that point will be delivered.
Retainer services require 30 days prior written notice for cancellation.
You agree to:
Provide accurate information, brand assets, and timely approvals.
Share access to relevant platforms (Meta, Google Ads, Shopify, Website, etc.).
Ensure product/service compliance with local laws.
Not request misleading, illegal, or unethical marketing activities.
Delays in providing inputs may extend project timelines.
Timelines mentioned in proposals are approximate and may change based on:
Client delays
Third-party issues
Platform technical issues
Unexpected workload changes
Whisky Labs is not liable for delays caused by external factors.
All final delivered work becomes your property after full payment.
Source files, raw content, internal strategy documents, and working files remain the intellectual property of Whisky Labs unless stated otherwise.
Whisky Labs may use completed work for portfolio, case studies, and marketing purposes.
Marketing includes variables beyond our control (competition, market conditions, platform changes, budgets).
We do not guarantee specific sales, leads, or ranking results.
Paid ad performance depends on budget, product quality, and market.
Both parties agree to maintain confidentiality of shared information, documents, login credentials, and project data.
Costs for third-party services such as hosting, domains, ad budgets, influencers, content creators, plugins, or software subscriptions are not included unless specified.
Influencer availability, performance, and deliverables depend on third-party creators.
Whisky Labs is not responsible for delays or unexpected cancellations by influencers/creators.
Any reshoot or extra content request will incur additional costs.
Whisky Labs is not responsible for:
Loss of profits, revenue, or data
Platform bans or ad account issues
Business losses due to external platform policies
Errors caused by client’s previous agencies or developers
Our total liability will not exceed the amount you paid for the services in the last 30 days.
Each service includes a fixed number of revisions as mentioned in the proposal.
Extra revisions will be billed additionally.
Revisions unrelated to the original scope are treated as new work.
Whisky Labs reserves the right to terminate the contract if:
Payments are delayed
Client engages in abusive or unethical behavior
Client violates platform policies or laws
Any unpaid dues must be cleared immediately upon termination.
These terms are governed by the laws of India. Any disputes will be handled in the jurisdiction of Mumbai, Maharashtra.
By using our services, signing a proposal, making payment, or accessing any work provided by Whisky Labs, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
